1. About us

These terms apply to all purchases and rentals in the Tidal Wave webshops at tidal-wave.eu and its country shops (at., be., ch., da., de., fr., nl., no., se. and uk.tidal-wave.eu).

2. Who these terms apply to

These terms apply to consumers and business customers. You are a consumer if you buy mainly for purposes outside your trade, business or profession. Where a section applies only to consumers or only to business customers, this is stated.

3. How the contract is made

You can shop as a guest or with a customer account. Put the items in the basket, go to checkout, enter your address and choose delivery and payment method. Before you place the order, you see a summary where you can check and correct all details. The contract is made when you click the button "Order with obligation to pay" (or the equivalent wording in your language). We then send you an order confirmation by email with these terms, our Right of withdrawal information and the model withdrawal form.

We store your order. You can see it in your customer account (if you have one), and we will send you a copy on request.

You can make the contract in English, Danish, German, French, Dutch, Norwegian and Swedish. The contract is made in the language of the shop you order in, and that language version applies to your purchase. For business customers, the English version prevails if the versions differ.

4. Prices and VAT

Prices are shown in the currency of the shop you use (EUR, DKK, SEK, NOK, GBP or CHF). For consumers, prices include the VAT of the country the goods are delivered to:

  • EU countries: the VAT of the EU country you have the goods delivered to.
  • Norway: Norwegian VAT, charged by Tidal Wave ApS NUF.
  • United Kingdom: UK VAT.
  • Switzerland: prices are shown without VAT, because the goods are exported from the EU. Swiss import VAT, any customs duty and the carrier's clearance fee are charged on delivery. See Payment & Shipping.

Shipping costs are added and are shown in the basket and at checkout before you place your order. The price that applies is the price shown when you place your order. We may change prices at any time, but not for orders already placed.

Business customers in other EU countries: If you enter a valid VAT number from an EU country other than Denmark, we check it in the EU's VIES system. If it is valid, we invoice without VAT under the reverse-charge rule, and you account for the VAT in your own country. We keep a record of the check as documentation. Danish business customers pay Danish VAT.

Member prices: Members of the Fisker Owners Association (FOA) get member prices when they are logged in with the email address registered with FOA. We check membership with FOA as described in our Privacy Policy. Prices for approved service partners are agreed separately.

5. Payment

The payment methods available depend on your country and currency, and are shown at checkout before you place your order. See Payment & Shipping for the full list and how each method works.

6. Delivery

We deliver to Austria, Belgium, Denmark, France, Germany, the Netherlands, Norway, Sweden, Switzerland and the United Kingdom. In Denmark we deliver with GLS, and to all other countries with FedEx. Shipping costs, delivery times and what happens if a parcel is returned to us are described in Payment & Shipping.

If no other delivery time is stated, we deliver without undue delay and no later than 30 days after the contract is made.

7. Pre-orders

Some items can be pre-ordered before they are in stock. Pre-order items are clearly marked. The expected delivery month is shown on the product page, in the basket and in your order confirmation. It is our best estimate based on information from our supplier.

Payment: As for all orders, the amount is reserved when you order and only charged when we ship the pre-order item. If the card reservation expires before the item arrives, we ask you to confirm the payment again before we ship. If you pay by invoice (payment in advance), we ship when we have received your payment.

Mixed orders: If an order contains both in-stock and pre-order items, we ship the in-stock items first, unless you ask us to ship everything together. You do not pay extra shipping for a split shipment.

If the pre-order is delayed: If we learn that the item cannot be delivered in the expected month, we tell you by email as soon as possible and give you a new expected date. If the new date is not acceptable to you, you can cancel the pre-order at any time before the item is shipped, and we refund everything you have paid for it, including shipping paid for it, within 14 days of your cancellation. If the item has not been delivered by the end of the expected month and you have not accepted a new date, you can also cancel. This does not affect your other rights in case of delay.

Withdrawal: You can also withdraw from a pre-order before and after delivery under the right of withdrawal (section 9).

8. Rental of diagnostic equipment

Some equipment, such as the WDI-2 OBD dongle with VCI cable, is rented, not sold. The equipment remains our property.

  • Rental period and price: 2 weeks. The price shown for the rental is the total of the rent and a security deposit of €400 excl. VAT (or the equivalent in your currency). The rental period starts on the day the equipment is delivered to you and ends on the day you send it back. You can extend the rental by writing to us before you send the equipment back; each started extra week costs €50 excl. VAT.
  • Deposit: The deposit is €400 excl. VAT. We refund the deposit within 14 days after we have received and checked the equipment.
  • Return: You must return the equipment complete (dongle, cable and packaging) no later than the last day of the rental period, using the prepaid return label we send you (with the equipment or by e-mail). Please reuse the original packaging. Return shipping is free.
  • Late return: If the equipment is sent back late, we deduct €50 excl. VAT per started extra week from the deposit. If the equipment has not been sent back 4 weeks after the end of the rental period, we keep the deposit and the equipment is considered lost.
  • Loss or damage: You must handle the equipment with care. If it is lost, or damaged beyond normal wear, we may charge the documented cost of repair or replacement, up to the amount of the deposit (€400 excl. VAT). We tell you before we deduct anything from the deposit.
  • Use: The equipment may only be used on your own Fisker Ocean and according to our instructions. It may not be lent or rented to others.
  • Defects: If the equipment does not work, contact us. We will replace it or refund the rent for the period it could not be used. We are not liable for damage caused by use contrary to our instructions. This does not limit your statutory rights.
  • Withdrawal: The rental is a service. By placing a rental order, you ask us to start the rental before the 14-day withdrawal period has ended. You can still withdraw within 14 days of making the contract, but you then pay a proportionate part of the rental price for the days until you told us that you were withdrawing. See the Right of withdrawal.

9. Right of withdrawal

If you are a consumer, you can withdraw from your purchase within 14 days without giving any reason. You can do this online with the "Withdraw from contract here" button in the footer of every page, or by email or letter. The full conditions, including refunds, return costs and the model withdrawal form, are in our Right of withdrawal, which is part of these terms.

The statutory right of withdrawal only applies to consumers. Purchases made as a business cannot be withdrawn unless we agree otherwise.

10. Defects and complaints (your statutory rights)

If an item is defective or not as described, you have the statutory rights under consumer sales law. We do not give an additional commercial guarantee unless a guarantee is expressly stated on the product page.

Consumers: You can claim for defects that were present when the item was delivered. How long you have depends on the law of the country where you live:

  • In general (Denmark, Austria, Belgium, France and Germany): 24 months from delivery.
  • Sweden: 36 months from delivery.
  • Norway: 24 months from delivery, or 60 months for items, or parts of items, that are intended to last considerably longer than 2 years.
  • Netherlands: there is no fixed period. You can claim for defects that appear during the period the item can reasonably be expected to last.
  • Switzerland: 24 months from delivery.
  • United Kingdom: goods must be of satisfactory quality, fit for purpose and as described. You can reject faulty goods for a full refund within 30 days of delivery. After that, you can ask for repair or replacement and, if that fails, a price reduction or refund. There is no fixed guarantee period, but you can bring a claim up to 6 years after delivery (5 years in Scotland).

A defect that appears within a certain period after delivery is presumed to have been present at delivery, unless we can prove otherwise. This period is set by the law of your country; for example, it is 12 months in Denmark and Germany and 24 months in France and Sweden.

Please tell us within a reasonable time after you discover the defect. A complaint made within 2 months of discovery is always in time. In Switzerland, the law requires you to notify us immediately after you discover the defect. Email info@tidal-wave.eu with your order number, a description and photos of the defect. Please do not return the item before we have replied; we will tell you how to return it, and we pay the reasonable cost of returning a defective item.

Depending on the defect and the law that applies to you, you can ask for repair, replacement, a price reduction or a refund.

Business customers: You must inspect the goods on delivery. Complaints about defects must be made without undue delay and no later than 12 months after delivery.

11. Personal data

We process your personal data in accordance with the GDPR and other applicable data protection law. You can read how in our Privacy Policy.

12. Liability

We are not liable for delays or failure to perform caused by circumstances beyond our reasonable control, such as natural disasters, war, strikes, pandemics, supplier insolvency or carrier failures. We tell you as soon as possible, and if the delay is significant for you, you can cancel the order and get a full refund.

If you are a consumer, nothing in these terms limits your mandatory rights under the law of your country of residence.

If you buy as a business, we are not liable for indirect or consequential loss, including loss of profit, operating loss or loss of data, and our total liability per order is limited to the amount paid for that order. These limitations do not apply in case of intent or gross negligence, or where the law does not allow them.

13. Complaints and dispute resolution

If you are not satisfied, please contact us first at info@tidal-wave.eu, so we can try to find a solution.

If we cannot agree, consumers can bring a complaint to the Danish consumer complaints system: Nævnenes Hus (the Mediation Team for Consumer Complaints and the Danish Consumer Complaints Board, Forbrugerklagenævnet), Toldboden 2, DK-8800 Viborg, Denmark, www.naevneneshus.dk.

If you live in another EU country, Norway or Iceland, you can also get free help with a complaint against a trader in another country from the European Consumer Centre in your country. In Denmark this is Forbrugereuropa (www.forbrug.dk). Consumers in the United Kingdom can get advice from Citizens Advice (www.citizensadvice.org.uk).

14. Governing law and courts

These terms and every contract with us are governed by Danish law. The UN Convention on Contracts for the International Sale of Goods (CISG) does not apply.

If you are a consumer, this choice of law does not deprive you of the protection of the mandatory rules of the country where you live. As a consumer, you can bring a case against us in the courts of your country of residence or in Denmark, and we can only bring a case against you in the courts of your country of residence.

If you buy as a business, the courts of Copenhagen, Denmark have exclusive jurisdiction.

We may update these terms. The terms that apply to your order are the ones shown when you placed it; they are also sent with your order confirmation.
